Welcome to TAP Clinical Education (accessible at E:\code\ahm\TapClinicalEducationLMS and associated domains). These Terms of Service ("Terms") govern your access to and use of our Learning Management System (LMS), website, courses, and certification services (collectively, the "Services").

The Services are owned and operated by TAP Clinical Education ("TAP", "we", "us", or "our"), founded by Amy J. Taphouse. By creating an account, purchasing seat licenses, or accessing our course materials, you ("you", "User", "Practitioner", or "Student") agree to be bound by these Terms. If you are accepting these Terms on behalf of a studio, salon, clinic, or other business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Please read these Terms carefully before using our Services, paying particular attention to the Clinical & Educational Disclaimer and the Academic Integrity & Anti-Cheat Policy.


1. Eligibility & Accounts

1.1 Professional Context

Our Services are specifically designed for personal service professionals, including but not limited to tattoo artists, micropigmentation specialists, body modification practitioners, beauty therapists, salon staff, and aesthetic practitioners. The Services are intended for individuals who are at least 18 years of age.

1.2 Account Creation & Security

To access courses, tracking dashboards, and certifications, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and secure.
  • Notify us immediately at [email protected] if you suspect any unauthorized access to or breach of your account.
  • Take full responsibility for all activities that occur under your account.

You must not share your personal account login credentials with any other person. Each practitioner must have their own unique account and license to ensure course progress tracking and certification integrity.


2. Course Licenses & Organization Management

2.1 Organization Accounts

Our platform supports multi-tenant organizations (e.g., studios, salons, or clinics). A User who establishes a studio profile is designated as the Organization Manager ("Admin"). Users invited to join the studio to take courses are designated as Students ("Members").

2.2 Seat Licensing

  • Admins may purchase seat licenses for specific courses (e.g., Clinical Safety & Hygiene) through our third-party billing processor, Lemon Squeezy.
  • Each seat license entitles one (1) individual Member of the organization to enroll in and complete the designated course.
  • Admins can assign purchased seats to Members via the studio dashboard and revoke unassigned or pending invites. Once a Member enrolls and begins a course, that seat license is consumed and is locked to that individual's account to maintain legal and educational traceability.
  • Revocation of active enrollments is only permitted under exceptional circumstances (e.g., employee termination prior to course commencement) and must be requested via support.

3. Academic Integrity & Anti-Cheat Policy

TAP Clinical Education provides accredited training that certifies practitioners in critical client safety and hygiene standards. To protect the credibility of our certificates, we enforce a strict Academic Integrity Policy.

3.1 Strict Mode & Anti-Cheat Detection

The LMS utilizes automated technical controls during examinations and quizzes to prevent cheating:

  • Focus Monitoring: During a quiz or exam, the platform monitors window focus, window blurring, and page visibility (e.g., if you switch tabs, minimize the browser, or open a search engine).
  • Warning System: If you leave the active exam page, the platform will detect focus loss, display a warning, and increment your warning count.
  • Automated Lockout: You are permitted a maximum of two (2) focus-loss events. Upon the third (3rd) focus loss or tab-switch, you will be automatically locked out of the exam.
  • Lockout Resolution: If you are locked out due to an anti-cheat breach, the system logs the lockout reason. You must contact [email protected] to request a manual review and reset of your exam attempt. Repeated violations may result in permanent suspension of your account without a refund.

3.2 Prohibited Conduct

In addition to automated detection, you agree that you will not:

  • Share quiz questions, answers, screenshots, or exam content with any third party.
  • Collaborate with other individuals while taking an exam.
  • Use external search engines, notes, artificial intelligence tools, or secondary devices during an exam.
  • Impersonate another individual or allow anyone else to take an exam on your behalf.
  • Bypass, disable, or attempt to subvert the focus-monitoring and anti-cheat mechanisms.

4. Clinical & Educational Disclaimer

[!IMPORTANT] READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND DEFINES YOUR RESPONSIBILITY.

4.1 Educational Purpose Only

All courses, videos, reference guides, text, checklists, and certifications provided by TAP Clinical Education are for educational and risk-awareness purposes only.

  • The training does not constitute medical, clinical, or formal legal advice.
  • Completing our courses does not grant you clinical qualifications, clinical licensure, or authorization to perform medical procedures, diagnose conditions, prescribe treatments, or act outside your professional scope of practice.
  • The material represents general guidelines, clinical observations from the founder’s 20+ years of NHS experience, and industry safety standards at the time of publication. It does not replace local, national, or sector-specific regulations, laws, or public health guidelines.

4.2 Practitioner Scope of Practice

You are solely responsible for practicing within your legally defined scope of practice under UK law (or the laws of your jurisdiction).

  • Our training is designed to help you identify clinical risks, recognize signs of client unwellness, and respond effectively in emergencies.
  • It remains your sole responsibility to ensure that your practices comply with local authority licensing (e.g., under the Local Government (Miscellaneous Provisions) Act 1982 or the Health and Safety at Work etc. Act 1974), insurance policies, and statutory regulations.
  • TAP Clinical Education, including its founder Amy J. Taphouse, accepts no liability for clinical decisions, client outcomes, or operational practices implemented by you or your studio following the consumption of our course materials.

5. Billing, Payments, & Refunds

5.1 Payment Processing

All payments for courses, seat packages, and subscription services are processed securely by Lemon Squeezy, our Merchant of Record. Your billing transaction will be subject to Lemon Squeezy’s Terms of Service and Privacy Policy. TAP does not store or process your credit/debit card details on our local database. We only record the transaction reference, payment amount, and seat count to credit your account.

5.2 Refunds

  • Digital Content Access: Due to the immediate delivery of digital course materials, refunds are generally not provided once a course has been accessed, or once a seat license has been assigned and started.
  • Unused Seats: If you purchase a package of seat licenses and change your mind, you may request a refund from Lemon Squeezy within 14 days of purchase, provided that none of the seats from that package have been assigned or accessed by any student.

6. Intellectual Property

6.1 Ownership of Content

All content on the platform, including video lectures, audio, text, graphics, course designs, interactive elements, quiz questions, logos, and certifications, is the exclusive intellectual property of TAP Clinical Education and is protected by UK and international copyright, trademark, and database laws.

6.2 Limited License

We grant you (and your assigned Students) a limited, non-exclusive, non-transferable, revocable license to access and view the course materials for which you have paid the appropriate fees, solely for your personal professional development or internal business training.

You must not:

  • Copy, record, download, scrape, distribute, resell, rent, or publicly display any portion of our course materials.
  • Modify or create derivative works based on our content.
  • Share course access links or certificates with unauthorized third parties.

7. Certificates & Verification

7.1 Certificate Issuance

Upon successful completion of all modules, quizzes, and exams of a course, and subject to passing the anti-cheat verification, TAP will issue a Certificate of Clinical Accomplishment (or equivalent designation).

7.2 Verification System

Each certificate is assigned a unique, cryptographically generated UUID and a QR code.

  • By default, certificate records are private to the User and their Organization Admin.
  • Users may toggle their certificate to Public mode. In Public mode, anyone with the unique link (e.g., prospective employers, licensing officers, or clients) can view the verification page confirming the student’s name, course title, and completion date.
  • We reserve the right to revoke or suspend any certificate if we discover that it was obtained via cheating, impersonation, or any other breach of these Terms.

8. Limitation of Liability & Indemnification

8.1 No Warranties

The Services and all materials are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course success. We do not warrant that the Services will be uninterrupted, error-free, or secure.

8.2 Limitation of Liability

To the maximum extent permitted by law (under the laws of England and Wales):

  • TAP Clinical Education (including its founder, educators, and contractors) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your access to or use of, or inability to access or use, the Services.
    • Any conduct, practice, or clinical decisions made by you or your salon/studio staff.
    • Any client injury, clinical complication, or business loss occurring in your workspace.
  • In no event shall our aggregate liability for all claims relating to the Services exceed the total amount paid by you to TAP for the specific course license or seat packages in the twelve (12) months preceding the event giving rise to the claim.

8.3 Indemnification

You agree to defend, indemnify, and hold harmless TAP Clinical Education, Amy J. Taphouse, and our contractors, partners, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable legal fees) arising from:

  • Your violation of these Terms.
  • Your practice or delivery of personal services to clients.
  • Any claim of negligence, malpractice, or injury brought by your clients or regulatory authorities.
  • Any breach of academic integrity or unauthorized distribution of course materials by you or your organization's members.

9. Suspension & Termination

We reserve the right, without liability and at our sole discretion, to suspend or terminate your account, organization profile, or access to the Services at any time, including:

  • If you breach any material provision of these Terms.
  • If you trigger repeated anti-cheat lockouts or are caught cheating.
  • If you fail to pay fees when due.
  • If we cease providing the Services.

Upon termination, your right to access course materials, student dashboards, and active certificate verification pages will immediately cease.


10. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Before initiating formal legal proceedings, we encourage you to contact us at [email protected] to resolve any grievances informally.
